School Bus Violation Attorney in Pennsylvania. Passing a stopped school bus in violation of 75 Pa.C.S. §3345 is one of the most seriously penalized moving violations in Title 75 — five points and a mandatory 60-day license suspension on a first offense. Five points from a single §3345 conviction puts most drivers more than halfway to the automatic suspension threshold. Attorney Sean Quinlan defends §3345 citations across central Pennsylvania. It requires all drivers to stop when a school bus has its red warning lights activated and its stop arm extended, indicating students are loading or unloading. The duty to stop applies to drivers approaching from both directions on most road types. Statutory exceptions: Divided highways with a physical separation barrier — oncoming traffic is not required to stop on the opposite side of a divided highway with a physical median. Controlled-access highways — school buses generally do not stop on limited-access highways. Points, fines, mandatory suspension, and incarceration under §3345. Points: 5 points under §1535 — assessed on a first offense. Fines: First offense: up to $250 fine plus costs. Second offense within five years: up to $1,000 fine plus costs. Subsequent offenses: up to $2,000 fine plus costs. Mandatory license suspension: First offense: 60-day mandatory suspension imposed by PennDOT under §1532. Second offense within five years: additional suspension at PennDOT's discretion. Incarceration: Section 3345 is a summary traffic offense — no mandatory incarceration on a standard citation. However, if the violation results in striking a child or causing injury, charges under §3714(b) (misdemeanor of the third degree, up to 1 year), §3732.1 (aggravated assault by vehicle — felony), or §3732 (homicide by vehicle — felony) can be filed. How we defend §3345 citations. Statutory exceptions: Was this a divided highway with a physical median? Was the bus actually in a loading or unloading operation? These are factual and legal questions we raise at the MDJ hearing. Stop arm and light activation: The stop arm must have been extended and the red lights activated. We challenge the officer's observation and any camera evidence regarding timing of activation. School bus cameras: Camera evidence must be properly authenticated. We challenge authentication, angle, vehicle identification, and timing in every camera-based §3345 case. Identity of the driver: Camera-based citations are issued to the registered owner — not necessarily the driver. If the registered owner was not driving, we challenge the citation on that basis. Counties we serve. Adams, Cumberland, Dauphin, Franklin, Lancaster, Perry, and York County. The sooner we talk, the more we can do. Call (717) 724-7503 | Schedule a consultation Attorney advertising.
